Tashkent, Uzbekistan (UzDaily.uz) — The Senate of the Oliy Majlis considered the Law “On Administrative Procedures” at a plenary session and rejected the version submitted for consideration following the discussion.

The document is aimed at establishing unified legal standards for the work of administrative bodies and improving the quality of public services.

During the review, senators noted several provisions that, in their assessment, are important for regulating administrative procedures. In particular, the law establishes the main principles governing such activities and sets out procedures for collecting evidence and adopting and enforcing administrative acts. These provisions are intended to ensure the legality of actions by government bodies and procedural guarantees for protecting citizens’ rights.

At the same time, members of the Senate pointed to systemic legal problems, gaps and ambiguous wording in the document that could complicate its practical application.

One of the disputed provisions was a requirement for mandatory pre-trial appeal of an administrative act before a person can go to court. Senators noted a possible inconsistency between this provision and Article 55 of the Constitution, which guarantees everyone judicial protection of rights and freedoms, including the right to challenge in court decisions, actions or inaction by government bodies, other organisations and their officials.

According to Senate members, such a legal conflict could lead to different interpretations of the provisions and complicate law enforcement practice.

In addition, senators said that the procedures for administrative bodies to make decisions and for appealing them require clearer regulation. Insufficient clarity in the relevant provisions could limit the effectiveness of protecting citizens’ interests.

The discussion also noted that the preparation of the law did not fully take into account the organisational, legal and infrastructure capacities of local government bodies to implement some of the proposed requirements.

Senators stressed that legislation on administrative procedures should ensure a consistent reduction in bureaucratic barriers and provide effective protection of citizens’ rights.

Following the review, the Senate concluded that it was inappropriate to approve the law in the presented version and rejected it.
