Uzbekistan Senate simplifies processing of undisputed claims

Tashkent, Uzbekistan (UzDaily.uz) — The Senate of the Oliy Majlis of Uzbekistan has approved a law simplifying the notarial processing and enforcement of undisputed claims, as well as reducing a number of procedures in judicial and enforcement proceedings.

The document “On Amendments and Additions to Certain Legislative Acts of the Republic of Uzbekistan” was considered at a regular plenary session of the Senate.

The amendments were made to the Civil Procedure Code and Economic Procedure Code, as well as the laws “On Enforcement of Judicial Acts and Acts of Other Bodies” and “On State Duty.” They provide for shorter deadlines for issuing court orders on undisputed claims, wider use of information and communication technologies in notarial activities, and optimization of fees for notarial actions.

One of the main changes will be to expand the possibility of applying to a notary for undisputed claims of up to 1,000 basic calculated values, subject to the criteria established by law. This will allow such claims to be processed and enforced through a notary without going to court.

In addition, notaries will be able to send enforcement writs containing QR codes directly to enforcement authorities electronically. This procedure will eliminate a number of excessive procedures related to submitting documents in paper form.

The amendments also concern the procedure for suspending the enforcement of court acts that have entered into force when they are appealed to a higher court. The relevant provisions are being clarified in the Economic Procedure Code.

The grounds for suspending the enforcement of court acts at the appellate, cassation and supervisory review stages are also defined separately. A person requesting suspension will have to substantiate that, if the measure is not applied, withdrawal may complicate or make enforcement of the court act impossible.

According to senators, the adopted amendments are aimed at reducing the workload of courts, cutting the time and financial costs for citizens and businesses, speeding up the processing of undisputed claims and improving the efficiency of enforcement proceedings.

The law was approved by senators.
