Tashkent, Uzbekistan (UzDaily.uz) — Orders issued by the head of Uzbekistan’s Presidential Administration will become a separate type of normative legal act and will be binding on state bodies, organizations and officials across the country.

The change is provided for by the constitutional law “On the Administration of the President of the Republic of Uzbekistan”, signed on 14 August.

The relevant amendments have been made to the law “On Normative Legal Acts”. Orders issued by the head of the Presidential Administration are not included in the current list of types of normative legal acts. Once the amendments take effect, they will be added to the list.

Under the hierarchy established by law, orders issued by the head of the Presidential Administration will have greater legal force than resolutions of the Cabinet of Ministers, orders and resolutions of ministries and agencies, as well as decisions of local authorities.

To regulate the new type of normative legal act, the law will be supplemented with a separate Article 12-1.

Under the provision, the head of the Presidential Administration will be able to issue orders based on the Constitution and laws, as well as presidential decrees, resolutions, orders and instructions. Such acts will be issued to ensure implementation of the president’s decisions and the effective organization of the Presidential Administration’s activities.

Orders issued by the head of the Presidential Administration will be binding on state bodies, enterprises, institutions, organizations and officials throughout Uzbekistan.

The amendments also affect the powers of local authorities. Orders issued by the head of the Presidential Administration will be added to Article 16 of the law “On Normative Legal Acts”, which sets out the grounds for adopting normative decisions by hokims and Councils of People’s Deputies.

As a result, such orders will be able to serve as a legal basis for normative decisions by local hokims and Councils.

In addition, amendments to Article 36 provide that the official text of an order issued by the head of the Presidential Administration will be authenticated by the head of the Presidential Administration.
