Tashkent, Uzbekistan (UzDaily.uz) — The Competition Committee of Uzbekistan has approved a regulation on introducing a risk-analysis system for business entities. The document provides for an automated assessment of companies regarding the probability of violations of advertising legislation.

The system will assign companies to one of three risk categories — high, medium, or low — based on an evaluation using a 100-point scale. Companies scoring more than 81 points will be classified in the high-risk category, while those scoring from 61 to 80 points will fall into the medium-risk category.

The assessment will be formed based on identified violations of advertising legislation requirements, with a specific number of points assigned to each infraction.

Up to 20 points are assigned for the violation of general advertising requirements. This category includes non-compliance with the requirements of legality, reliability, and accuracy of advertising, violation of language requirements, advertising of prohibited goods, as well as improper information about promotional campaigns.

Inappropriate advertising can add up to 15 points. In particular, this accounts for violations of restrictions on advertising targeting minors, the use of hidden advertising, and non-compliance with requirements for comparative advertising.

Up to 25 points are allocated for violations of the rules for placing advertisements in public places and the media, including outdoor advertising, advertising on television, radio, transport, in print publications, and sponsored advertising.

Violations of requirements for the advertising of specific categories of goods and services carry the greatest weight in the risk assessment, accounting for up to 40 points.

These include violations in the advertising of medicines, alcohol and tobacco products, goods requiring special certificates, licenses, or permits, as well as energy drinks, securities, weapons, and biologically active supplements.
