Uzbek Court Orders Destruction of 53 Tonnes of Counterfeit Electrodes

Tashkent, Uzbekistan (UzDaily.uz) — The Tashkent Interdistrict Economic Court has upheld a trademark owner's claim in a trademark infringement case and ordered the destruction of 53 tonnes of counterfeit welding electrodes imported into Uzbekistan, the Ministry of Justice said.

During the proceedings, the court found that the defendant had imported products bearing a designation confusingly similar to the ARSENAL trademark. According to the court, the marking could mislead consumers and infringed the trademark owner's exclusive rights.

The court ordered the seizure and destruction of the 53 tonnes of counterfeit products stored at a customs warehouse.

The defendant was ordered to bear the costs of destroying the goods.

The court also ordered the defendant to reimburse the claimant's legal expenses, including a state duty of 8,240,000 soums and postal costs of 41,200 soums. The total amount awarded was 8,281,200 soums.
