Uzbekistan Moves to Expand Constitutional Court Rights Protections

Tashkent, Uzbekistan (UzDaily.uz) — The Legislative Chamber of the Oliy Majlis of Uzbekistan considered in its first reading a draft law to refine mechanisms for protecting the rights of citizens and legal entities through the Constitutional Court.

The document provides for suspending proceedings in a relevant case if the Supreme Court, acting on the initiative of lower courts, applies to the Constitutional Court to review the constitutionality of a law to be applied in that specific case.

In addition, the draft law proposes establishing a distinct procedural ground for reviewing judicial acts if the Constitutional Court declares a law applied in a specific case to be unconstitutional.

The document also defines the procedure for reviewing judicial cases and resuming proceedings based on decisions of the Constitutional Court.

Lawmakers noted that adoption of the draft law will enhance legal certainty in judicial practice, expand opportunities to restore violated constitutional rights and freedoms, and eliminate unnecessary bureaucratic procedures.

Following discussions, deputies passed the draft law in its first reading.
