Lawmakers Back Bill on Constitutional Court Rights Protection

Tashkent, Uzbekistan (UzDaily.uz) — The Legislative Chamber of the Oliy Majlis of the Republic of Uzbekistan has approved in the second reading a bill aimed at improving mechanisms for protecting the rights of citizens and legal entities through the Constitutional Court.

The bill introduces measures to strengthen judicial protection of human rights and freedoms and improve the implementation of Constitutional Court decisions in judicial practice.

Under the proposed amendments, proceedings in a case would be suspended if the Supreme Court, acting on the initiative of lower courts, refers to the Constitutional Court the question of whether a legal act to be applied in that case complies with the Constitution.

The bill also establishes a procedural basis for reviewing a court decision that has already entered into legal force if the Constitutional Court determines that the law applied in a specific case is inconsistent with the Constitution.

According to lawmakers, the bill will improve legal certainty in judicial practice, expand opportunities to restore violated constitutional rights and freedoms, eliminate unnecessary bureaucratic procedures, and ensure more effective implementation of Constitutional Court decisions.

Following its consideration, deputies approved the bill in the second reading.
