Tashkent, Uzbekistan (UzDaily.uz) — The Senate of Uzbekistan’s Oliy Majlis has approved the Constitutional Law “On the Constitutional Court of the Republic of Uzbekistan” at its 20th plenary session.

The law is aimed at implementing updated constitutional provisions and expanding opportunities for citizens and legal entities to protect their constitutional rights.

The need for the legislation is linked, among other things, to existing gaps in the preliminary review of applications and the use of digital technologies in the Constitutional Court’s activities.

One of the key innovations will be the introduction of an information system for the court. It will allow applications to be submitted electronically, court hearings to be viewed online, and participants to join proceedings via videoconferencing and a mobile application. The system will also enable live broadcasts of open hearings over the internet.

The law establishes a procedure for the preliminary review of submitted applications. The process will take up to 15 days. Applications that do not fall within the Constitutional Court’s jurisdiction will be forwarded to the relevant authorized bodies, or a decision will be made to refuse their acceptance.

The legislation also establishes a mechanism for implementing Constitutional Court decisions. If a regulatory legal act is declared unconstitutional, the body that adopted it will be required to bring the document into compliance with the Constitution within three months.

The law also provides for the review of court decisions adopted on the basis of regulatory legal acts that have been declared unconstitutional.

To improve the composition of the Constitutional Court and ensure the impartiality of its activities, the law provides for the establishment, jointly with the Supreme Judicial Council, of a reserve of candidates for Constitutional Court judge positions.

According to senators, the new provisions are aimed at strengthening the protection of the constitutional rights of citizens and entrepreneurs, increasing the openness of the judicial system and expanding access to constitutional justice.

The Constitutional Law was approved by members of the Senate.
