Uzbekistan strengthens legal protection of intellectual property

Tashkent, Uzbekistan (UzDaily.com) — In its second reading, the Legislative Chamber of the Oliy Majlis reviewed a draft law aimed at further strengthening legal protections in the field of intellectual property.

It was emphasized during the session that Uzbekistan has in recent years been systematically implementing a unified state policy in this domain. Particular attention has been given to raising legal awareness, fostering a culture of respect for intellectual property, and ensuring the protection of the legitimate rights and interests of rights holders.

To enhance accountability for violations involving the use of intellectual property and to align national legislation with international standards, the draft law proposes amendments and additions to four key legal codes: the Criminal Code, the Criminal Procedure Code, the Civil Code, and the Code of Administrative Responsibility. The proposed changes include tougher penalties for infringements of copyright and related rights, as well as violations concerning industrial property.

Notably, Article 149 of the Criminal Code is to be expanded to include liability for misappropriation of authorship related to plant variety achievements and integrated circuit topographies. Additional revisions have also been made to Article 149³ during the preparation of the draft for the second reading.

Amendments have also been introduced to Article 177 of the Code of Administrative Responsibility. The bill establishes penalties for the unauthorized use of trademarks, service marks, geographical indications, and appellations of origin that are not registered in the Republic of Uzbekistan.

The adoption of this law is expected to further cultivate legal culture, ensure the effective protection of the proprietary interests of intellectual property holders, prevent the spread of counterfeit goods, and raise legal accountability among both the general population and entrepreneurs regarding the lawful use of intellectual property assets.

The bill was approved by the deputies.
