Tashkent, Uzbekistan (UzDaily.com) -- The Address of the President of the Republic of Uzbekistan Sherzod Mirziyoyev to Oliy Majlis defines specific tasks for the radical reform of licensing and licensing procedures in the business.
In order to fulfill this order, each licensed type of activity and permit were analyzed jointly with the relevant authorized bodies. In particular, the study covered 266 licensed activities and 137 permits.
The studies and analysis showed that bureaucratic formality is still allowed when passing through administrative procedures, duplication of licenses and permits, and information technologies are not up to the mark.
In order to eliminate systemic problems and shortcomings in the field, as well as institutional reforms through the introduction of information technology, a draft Decree of the President of the Republic of Uzbekistan “On measures to radically improve licensing and permitting procedures” has been developed.
In accordance with the project, about 1,000 established bureaucratic processes are simplified. In particular:
Firstly, for the first time, the notification procedure is being introduced as a separate institution.
When sending a notification, individuals and legal entities undertake to comply with the requirements and conditions established by law, and also confirm that their activities comply with the established requirements. At the same time, to start an activity or carry out an action, it is not necessary to consider documents and make a decision by the authorized body.
The draft Decree stipulates the introduction of a notification procedure in place of 44 licensing and 13 licensing procedures.
In particular, by notifying the authorized body, it will be possible to begin activities on preschool education, pawnshop, concert-entertainment, veterinary-medical, retail trade in alcoholic beverages, etc. Registration of mass media is also transferred to the notification procedure
Secondly, the number of activities requiring a license and permission is significantly reduced.
It is proposed to exclude from licensing activities that will not harm human health and society, as well as to transfer certain types of activities with a low level of risk to alternative regulatory methods. At the same time, some types of licenses and permits are canceled by applying the “regulatory guillotine”.
According to the draft Decree, about 100 licensed activities and 35 permits are canceled (31) and transferred to alternative regulatory methods.
As a result of the reduction in the number of licenses and permits, entrepreneurs will save more than 125 billion soums per year.
In this direction, the licensing of audit, appraisal, realtor activities, phonogram production, urban, suburban and intercity transportation of goods by road is canceled. Also, it is proposed to cancel the permit to attract foreign labor, to engage in coaching, a passport of a sports facility.
Thirdly, licensing permits and notification procedures will be fully digitalized.
For this, the information system "License" will be developed and the practice of filing documents, reviewing and issuing all types of licenses, permits and notifications through a single portal will be established.
It is established that circulation, sending documents to authorized bodies will be carried out only in electronic form.
Also, if for the issuance of a license it will be necessary to obtain certificates or other documents issued by another body, the authorized body, without the participation of the entrepreneur, will independently receive these documents through a single system.
The project envisages the abandonment of the practice of issuing licenses and permits on special forms and a complete transition to the issuance of electronic documents with a QR code.
As a result, there will be limited the occurrence of corruption in the implementation of administrative procedures, entrepreneurs will not have time and money associated with their arrival and departure to the city of Tashkent, in addition, it will be possible to save funds in the amount of more than 13 billion soums allocated by state bodies for manufacturing special forms, as well as 3.5 million units of paper.
The Ministry of Justice raised grant funds to develop this information system and program.
Fourth, the project stipulates the widespread simplification of business processes and administrative procedures.
Licensing requirements and conditions are revised in terms of reducing the rules restricting competition, including the conditions that impede the entry of goods and services to the market.
In particular, measures will be implemented aimed at further reducing and simplifying the procedures for issuing 115 types of licenses and permits, as well as reducing the time required to process documents for 14 types of activities.
For example, when obtaining a license to open a credit bureau, it is proposed to cancel the requirement to provide a document confirming consent to credit exchange with at least 10 commercial banks, exclude the minimum requirements for the size of the authorized capital for certain types of activities, and also establish that certification Tour operator services are voluntary.
Fifth, it is proposed to establish that the issue of canceling a license or permit at the initiative of the authorized body is decided only in court.
However, if the application for a license is not considered on time, then with the consent of the business entity, a license or permit will be automatically issued to him. Such an opportunity will be provided in the information system "License".
Sixth, the right of state unitary enterprises and institutions to carry out licensed activities without obtaining an appropriate license is canceled.
This rule led to the dominance of state-owned enterprises over private entrepreneurs, the creation of unequal market conditions, as well as the monopoly position of state-owned enterprises. At the same time, negative consequences such as the inability to monitor compliance by these organizations with license requirements and conditions also arose. According to the project, the above organizations should take measures by the end of this year to issue the relevant licenses.
Seventh, measures will be taken to systematize and codify legislation governing relations in the field of licensing procedures, as well as to reduce the regulatory burden.
In particular, a unified draft law will be developed by combining the laws “On licensing of certain types of activities”, adopted 20 years ago, and “On licensing procedures in the field of entrepreneurial activity”.
In addition, passports of licenses and permits are being introduced. As a result, entrepreneurs will not need to read voluminous provisions. Basic information and requirements for starting a business will be contained in one document - a passport.
At the same time, conditions are being created for carrying out reforms of the licensing system and licensing procedures not on a one-time basis, but on a regular and effective basis.
Thus, the draft Decree of the President of the Republic of Uzbekistan “On measures to fundamentally improve licensing and licensing procedures” is a very important, new and up-to-date document that comprehensively covers all issues, as well as aimed at radically simplifying this area in our country.
The implementation of the draft Decree will ensure transparency of the licensing and permitting system, harmonization (unification) of administrative procedures, increasing the responsibility of business and government bodies, and will also be a strong blow against corruption opportunities in this area.
