Tashkent, Uzbekistan (UzDaily.com) -- In recent years, the attitude towards land and land use in our country has radically changed. This is no coincidence. Today we are witnessing that by generating income from every inch of land, families can be well-served and economic stability can be achieved.
It should be noted that in recent years, a number of laws and regulations have been adopted to develop the sector. However, in the regulatory legal acts in this direction, some issues related to the management of dekhkan farms are not fully disclosed.
For example, according to the current legislation, land plots are provided to citizens for running a dekhkan farm on the basis of the right of ownership of life-long inheritance. As a result, due to the ambiguity in legal concepts on the lands of dekhkan farms, the population unauthorizedly builds houses and other buildings used as housing.
At the same time, the fulfillment of such obligations as the preservation of lands, increasing their fertility and compliance with agrotechnical requirements were in the background.
At the regular meeting of the Legislative Chamber of the Oliy Majlis, held on 26 August 2020, in the discussion of the draft law "On Amendments to the Law of the Republic of Uzbekistan" On Dekhkan Farms ", which became the subject of active discussion, attention was drawn to these aspects.
The deputies also touched upon the results of the studies carried out in this direction. According to the studies, the activities of dekhkan farms are insufficiently regulated, their number, accounting of the allocated land has not yet been established, information on dekhkan farms is maintained in different ways. Another aspect is that the share of land per capita is shrinking due to its growth.
The draft law takes a serious approach to similar problematic issues. Its main goal is to regulate relations in the field of creating a dekhkan farm, determining the legal framework for its activities, as well as state support for dekhkan farms.
So what other important principles are reflected in this document?
As the members of parliament emphasized, the bill envisages the introduction of a system for the allocation of land plots for lease instead of the practice of direct allocation of land plots to dekhkan farms on the basis of the right of ownership of lifetime inheritance. The project also establishes a lease term for gardening and viticulture 50 years, vegetable growing and melon growing 30 years, the minimum area and an increase in the maximum area (from 0.06 hectares to 1 hectare) of the land plot allocated to dekhkan farms for rent, and it is also established that the income of the farm is not a tax base.
According to the people’s representatives, the adoption of the bill will serve to prevent illegal or various seizures of land and further strengthen the guarantees of land rights. At the same time, permission for farmers to conduct dekhkan farming on land freed from main crops on a lease basis for one or several seasons will contribute to the efficient use of temporarily vacant land.
After discussions, the bill was adopted in the first reading.
