Tashkent, Uzbekistan (UzDaily.com) -- According to the relevant Decree of the President of the Republic of Uzbekistan and the resolution of the Cabinet of Ministers from 2 December 2019, a legal experiment was carried out in Syrdarya region to approve the privatization of non-agricultural land.
A temporary administrative regulation was approved on the procedure for the privatization of land owned by individuals and legal entities. Along with this, a temporary regulation was developed on the procedure for the privatization of free agricultural land plots not owned by anyone, through an electronic online auction (sale).
The experiment was attended by 7 representatives of the legislative chamber of the Oliy Majlis, 165 deputies of regional, city and district Kengashes. They carried out a large-scale propaganda of the established procedures among the subjects of privatization.
In particular, explanations about the purpose of the experiment were carried out in 230 settlements of Syrdarya region.
In addition, legal entities and individuals were provided with a number of information about the benefits of this work. It was noted that individuals will be able to carry out entrepreneurial activities by attracting credit funds from banks as a result of the laying of privatized land plots. It was noted that due to the further sale (sale) of the privatized land plot, it is possible to assess the value of this land plot at a price higher than the market price. It was also emphasized that the main advantages of the law are the inviolability of the privatized land plot and the protection of the rights to the personal property of legal entities. In general, people have the opportunity to distinguish between profit and damage from work performed.
A permanent regional headquarters has been established in the building of the Land Resources Administration and State Cadastre of Syrdarya region. This will cover the coordination of the process, the prompt elimination of possible problems during the legal experiment and the study of relevant proposals.
In addition, all public service centers of the region provide for the possibility of accepting applications for the privatization of agricultural land.
To achieve efficiency, it was necessary to carry out a number of works. One of them is the issue of digitalization of activities, which requires a special information system.
In this regard, the Ministry of Economic Development and Poverty Reduction, the Center for E-Government and Digital Economy Project Management, the State Committee for Automation of the State Agency for Electronic Government and Digital Economy, as well as the Automation Development Committee agreed to implement and coordinate the process. This system is important in that it specializes in bringing into electronic form the privatization procedure concerning individuals and legal entities, considering submitted applications and making decisions on them.
In the course of the legal experiment, 64 applications were processed through the electronic system and appropriate decisions were made on them, which were divided by the number, content, requirements and order of applications.
In most cases, it turned out that the land plots allotted to individuals for entrepreneurial and urban planning activities were not subject to development, and the issue of privatizing land adjacent to apartment buildings had not been settled. As a result of the fact that the privatization of land on the territory of small industrial zones is not provided for by law, and such plots are not taken into account by the socio-economic development of the territories, they are highly valued. It was revealed that there are a number of problems in the organizational and technical work.
The problems and results of a legal experiment in the region were presented to the authorities. Suggestions for action were put forward.
A Resolution of the Cabinet of Ministers "On further improvement of the process of privatization of non-agricultural land in the Syrdarya region" was developed with the implementation of the norms and the draft Law "On amendments and additions to the Law" On privatization of non-agricultural land ".
When developing them, the proposals of deputies, deputies of local councils and experts in various fields were taken into account.
Each of the proposals, changes in implementation, took into account the real situation on the ground. Requirements for solving problems have been developed. This will eliminate similar problems not only in one region, but in many areas.
