Tashkent, Uzbekistan (UzDaily.com) - On 20 January, the Committee on Defense and Security of the Legislative Chamber of the Oliy Majlis discussed a draft law on amendments and additions to some legislative acts of the Republic of Uzbekistan in connection with the improvement of legislation on compulsory civil liability insurance of vehicle owners.
As noted, according to the analysis of administrative offenses related to road traffic accidents in the territory of our Republic, 13 701 were committed in 2018, 24 005 in 2019, and 16 023 not related to bodily injury in 2020. These administrative offenses were registered by employees of the State Traffic Safety Service and sent to court for consideration. 40 percent of the participants in road accidents said that they have no claims to each other and that their goal is to receive insurance compensation from insurance companies in a short time.
According to the current legislation, in case of a road traffic accident, an inspector of the road patrol service is called, documents are drawn up, a medical and narcological examination is carried out and an insurance company is notified, a preliminary investigation, various examinations, and trials are carried out.
In addition, participants in road accidents collects all vehicle documents, expert opinions, court decisions and transfers them to the insurance company. After examining the documents, the insurance company decides whether to pay compensation or refuse. It takes an average of 30-50 days to complete these actions, which leads to congestion and additional costs.
The new provisions of the law provide for the establishment of a simplified procedure for processing documents on road accidents not related to bodily injury, without the participation of law enforcement officers by mutual consent and drawing up a notification of a road traffic accident.
In the event of a traffic accident, participants fill out a notification without the participation of a law enforcement officer, undergo a medical and drug examination and conduct an assessment of technical damage to vehicles, submit an application to the insurance company within 3 days. The insurance company will review the documents and within 15 days will make a decision to issue compensation or refuse.
The draft law envisages the introduction of a new rule of exemption from administrative liability in the Code of Administrative Liability in connection with the issuance of a notification of a road traffic accident, as well as the introduction and definition of the concept of a notification of a road traffic accident in the Law on Compulsory Civil Liability Insurance of Vehicle Owners.
The bill also defines the grounds, rules and procedure for registering a road accident not related to bodily injury, without the participation of a law enforcement officer. A similar procedure applies in countries such as the Russian Federation, Belarus, Ukraine, France and Belgium.
The introduction of a procedure for processing documents on road traffic accidents without the participation of law enforcement officers (Europrotocol) makes it possible to eliminate the "human factor", red tape, waste of citizens’ time when conducting direct communication between road safety specialists and drivers, as well as improving the quality of road handling. -transport accidents associated with bodily injury and prevention of congestion on highways by saving on average 2-3 hours for inspectors of the road patrol service to register a road traffic accident.
