Uzbekistan’s Criminal Code to be supplemented with articles on confiscation

Tashkent, Uzbekistan (UzDaily.com) -- A draft law "On Amendments and Additions to Certain Legislative Acts of the Republic of Uzbekistan in connection with the improvement of the system of combating legalization of proceeds from criminal activity, financing of terrorism and financing the proliferation of weapons of mass destruction was posted on the portal", Norma.uz reported.

The draft law was prepared by the General Prosecutor’s Office, they are invited to supplement the General Part of the Criminal Code with Section Eight "Property Coercive Measures". It determines that coercive measures of a property nature in the form of special confiscation can be applied on the basis of a sentence or a court ruling for the purpose of gratuitous seizure and transfer of property to the state.

This property will include cash and other property:

received as a result of criminal activity, as well as any profit or benefit received from the use of this property;

received as a result of criminal activity, fully or partially converted or altered into other property or money and other property added to money and property received from legal sources;

intended or used for the purpose of financing or otherwise providing for extremist or terrorist activities, the proliferation of weapons of mass destruction or an organized criminal group or criminal community;

as well as weapons, objects, devices or other means of committing a crime.

Property obtained as a result of criminal activity and transferred by the person who committed the crime into the possession of other persons will also be subject to confiscation.

If funds and other property obtained as a result of criminal activity are fully or partially converted or changed into other property, or funds and other property are added to funds and property obtained from legal sources, special confiscation applies only to the part of the property received as a result of a crime.

The court, when applying special confiscation, will have to accurately indicate the confiscated property.

The draft law envisages amendments and additions to other chapters and articles of the Criminal Code, as well as to the Criminal Procedure Code, the Code of Administrative Responsibility, the Criminal Executive Code, the laws "On the State Customs Service", "On the State Tax Service", " On normative legal acts ", etc.
