The working group discuss Constitutional Law

Tashkent, Uzbekistan (UzDaily.com) -- At the next plenary session of the Senate of the Oliy Majlis, it is planned to consider the Constitutional Law of the Republic of Uzbekistan "On the Constitutional Court of the Republic of Uzbekistan".

In this regard, today, on 17 February, a meeting of the working group of the Senate Committee of the Oliy Majlis on judicial and legal issues and anti-corruption was held. This Law was preliminarily discussed in the event, held in the format of videoconferencing with the participation of senators, members of the Jokargy Kenes of the Republic of Karakalpakstan, standing commissions of regional, district and city Kengashes of people's deputies for ensuring the rule of law and combating corruption, as well as experts, specialists and representatives of the media.

During the discussion, it was noted that the adoption of the Constitutional Law "On the Constitutional Court of the Republic of Uzbekistan" will serve to broader protection of human rights.

Thus, at present, the activities of the Constitutional Court are regulated by the Constitutional Law "On the Constitutional Court of the Republic of Uzbekistan", adopted on 31 May 2017. However, the procedural rules of legal proceedings in the Constitutional Court are determined by the rules approved by the Constitutional Court itself.

The legislation on the constitutional courts of most countries provides that such norms are established by law and not by the Constitutional Court. Since the procedural rules of office work are directly related to the implementation of human rights, and thus they must also be established by law.

In addition, an analysis of the practice of constitutional proceedings shows that in our country, in the protection of the constitutional rights of citizens, there are a number of acute problems to be solved and issues that require legal regulation.

In particular, the large-scale democratic reforms carried out in our country in 2017-2020 require further democratization of the constitutional proceedings. One of its directions is the introduction of the institution of constitutional complaint as an effective instrument for protecting human rights, that is, providing citizens and legal entities with the right to appeal to the Constitutional Court to determine the constitutionality of laws that do not comply with the Constitution, due to the fact that these laws violate their constitutional rights.

The adoption of this Law contributes to raising the constitutional legal procedure to a new level.

Based on the foregoing, by the Law, citizens and legal entities, the National Center for Human Rights of the Republic of Uzbekistan, the Commissioner under the President of the Republic of Uzbekistan for the protection of the rights and legitimate interests of business entities and the Deputy Commissioner of the Oliy Majlis of the Republic of Uzbekistan for Human Rights (Ombudsman) - the Commissioner for Children's Rights is provided the right to appeal to the Constitutional Court. This expands the circle of subjects applying to the Constitutional Court.

At the meeting, the members of the expert group under the Committee expressed their proposals and opinions on this Law.
