Tashkent, Uzbekistan (UzDaily.com) -- A Presidential resolution “On measures to improve the procedure for allocating land plots for engineering and communication networks” was adopted.
The Resolution approved the "Road Map" to improve the procedure for allocating land plots for engineering and communication networks.
As part of the Roadmap, the institution of the right to limited use of someone else’s land (servitude) will be developed.
Legal relations will be improved in the sphere of the use of land plots allocated with the right of permanent use.
The following procedure for allocating land for engineering and communication networks has been introduced:
- land plots are allocated for railway lines and highways with the right of permanent use based on the decision of the khokims of the regions;
- allocation of land plots for power lines, communication networks, gas, oil, water and sewer pipes, as well as internal roads and shallow water bodies as part of agricultural and forestry lands with the right of permanent use is not required. For these purposes, an easement is established;
- easement right can be formalized in the form of an agreement, if such an agreement is not reached - by a court decision;
- land tax (rent) for the land on which the easement is established is paid by the owner, owner, user and tenant.
The Resolution established the Government Commission to consider the issues of changing the categories of the land fund of agricultural land and the forest fund.
