The person, who committed the offense, may be released from liability in the event of compensation for the damage caused and reconciliation with the victim

Tashkent, Uzbekistan (UzDaily.com) – The law “On amendments and additions to the Code of Administrative Responsibility” was signed by the President of Uzbekistan.

In connection with bringing the Law into conformity with the Code of Administrative Responsibility, the institution of exemption from administrative responsibility was introduced.

According to the law, a person who has committed administrative offenses provided for by a number of articles of the Code may be released from administrative liability if he admits himself guilty, reconciles with the victim and eliminates the damage caused.

The body (official) considering the case of an administrative offense, in connection with the reconciliation of the parties, makes a decision to send the case to the court, then sends the case materials to the court to resolve the issue of exemption from administrative responsibility.

The victim or his legal representative may file a petition for conciliation during the period when the case is being considered by the competent authorities (officials), as well as at any stage of the trial, but necessarily before the court makes a decision.

If there are several victims in the case, then conciliation proceedings are possible only if reconciliation has been reached with all the victims.

The proceedings on reconciliation cases shall be held no later than 3 days from the date of the receipt of the case by the court.

A person who has committed an offense repeatedly within a year is not exempt from administrative liability due to the reconciliation of the parties.
