Tashkent, Uzbekistan (UzDaily.com) -- At the eleventh plenary meeting of the Senate of the Oliy Majlis, the Law of the Republic of Uzbekistan "On Amendments to the Constitution of the Republic of Uzbekistan" was discussed.
It was noted that, at the initiative of the head of state, over the past four years, large-scale organizational and legal measures have been carried out aimed at cardinal reform of the judicial and legal sphere, taking into account the fact that justice is of particular importance in ensuring the rule of law in the country, implementing the constitutional rights of citizens and establishing justice in society.
In order to resolve problematic issues that have persisted in the judicial and legal sphere for many years, more than ten decrees and resolutions of the President have been adopted and the Parliament has again adopted three codes and a number of laws have been amended and supplemented accordingly, aimed at improving the quality and efficiency of justice.
It should be noted that this Law is a logical continuation of the judicial and legal reforms carried out in the country. In particular, the Decree of the President of the Republic of Uzbekistan "On additional measures to further improve the activities of the courts and increase the efficiency of justice" from 24 July 2020 created the legal basis for the implementation of a new stage of judicial and legal reforms.
In accordance with the Law developed in order to ensure the implementation of this Decree, in order to improve the procedure for considering the legality, validity and fairness of court decisions, taking into account the best foreign experience, expanding opportunities to achieve justice in the judicial system, from 1 January 2021, it is provided:
creation of courts of general jurisdiction of the Republic of Karakalpakstan, regions and the city of Tashkent on the basis of regional courts and courts equivalent to them for civil cases, criminal cases and economic courts, while maintaining the strict specialization of judges and with the creation of separate judicial collegia by types of legal proceedings;
the creation of inter-district administrative courts in the Republic of Karakalpakstan, regional centers and the city of Tashkent, specializing in the consideration of cases arising from administrative procedures and other public legal relations, in this regard, the abolition of district (city) administrative courts. At the same time, it is envisaged to preserve the administrative courts of the Republic of Karakalpakstan, regions and the city of Tashkent.
Based on this, taking into account the implementation of organizational and structural changes in the judicial system, appropriate amendments are made to Article 107 of the Constitution of the Republic of Uzbekistan.
The implementation of this Law, along with improving the management of the judicial system, achieving organizational, financial and logistical support for regional and equivalent courts, will first of all make it possible to prevent citizens from going to courts, to solve their problems in one place.
