Stricter punishment for computer fraud introduced in Uzbekistan

Tashkent, Uzbekistan (UzDaily.com) -- The President of Uzbekistan Shavkat Mirziyoyev signed a Law “On amendments and additions to some legislative acts of the Republic of Uzbekistan”.

The law introduces the following amendments and additions to:

Criminal Code. In particular, the punishment for fraud using computer equipment has been toughened. Now such an act is punishable by a fine of 300 to 400 sizes of basic estimated value or correctional labor from 2 to 3 years or imprisonment from 5 to 8 years with deprivation of a certain right (previously a fine of 100 to 300 sizes of basic estimated value or correctional labor up to 3 years or restriction of freedom from 3 to 5 years or imprisonment from 3 to 5 years).

The Code of Administrative Liability is supplemented by Article 641. It envisages liability in the form of a fine or administrative arrest for disrespectful attitude towards objects of material and cultural heritage (this category of cases will be considered by criminal courts).

Disrespectful attitude to objects of material cultural heritage includes:

- desecration of them by drawing inscriptions, drawings or their damage;

- commission of actions discrediting or ridiculing objects of material cultural heritage, including their historical, scientific, artistic or other cultural value;

- committing actions in relation to objects of material cultural heritage that violate public order.

From now on, such acts will be punished by a fine of 5 to 10 sizes of basic estimated value. In the event that this entails minor (up to 30 sizes of basic estimated value) damage - a fine in the amount of 10 to 15 sizes of basic estimated value, small (30 to 100 sizes of basic estimated value) damage - a fine of 15 to 20 sizes of basic estimated value. Repeated commission of such acts will entail arrest for 15 days or a fine in the amount of 20 to 30 sizes of basic estimated value.

Law "On Compulsory Insurance of the Carrier’s Civil Liability". In particular:

- the conceptual apparatus is specified. So, now at the level of the law it is provided that the carrier is not only a legal entity, but also an individual entrepreneur (the norm comes into force on 19 January 2023);

- the list of state bodies exercising control over the fulfillment of the carrier’s obligation to insure its civil liability is limited:

- Ministry of Transport;

- Civil Aviation Agency under the Ministry of Transport;

- Inspectorate for the supervision of the safety of railway transportation under the Ministry of Transport.
