President signs law “On order of serving of administrative arrest”

Tashkent, Uzbekistan (UzDaily.com) -- President of Uzbekistan Shavkat Mirziyoyev signed a law “On order of serving of administrative arrest” on 9 January 2017.

Legislative Chamber of Oliy Majlis of Uzbekistan passed the law on 24 November 2016 and Senate of Oliy Majlis of Uzbekistan approved it on 13 December 2016. The law will come into force 24 months after official publication of the law. The document was published in local media on 10 January 2017.

The document envisages legal status of special receivers for detention of persons, subject to administrative arrest, the order of their reception, detention and release, rights and duties, disciplinary measures and other rules relating to the execution of administrative arrest.

The law will strengthen the protection of the rights and freedoms of detainees, ensure single practice of serving administrative detention, enhancing the effectiveness of law-enforcement bodies and the responsibility of their employees in the sphere.

It sets rights and responsibility of administration and employees of special detention site, as well as reimbursement of expenses.

It also sets order of use of encouragement and disciplinary action against persons under administrative arrest, punishments for violation of laws and orders of the detention site’s employees.

The law said that administration of detention sites could use audio-visual, electronic and other technical means of supervision and control to prevent crimes and violations in the site. The Interior Ministry of Uzbekistan approves the list and order of the use of these means, it added.

The document said that of Oliy Majlis of Uzbekistan should notify persons under administrative arrest on use of technical means of supervision and control.
