Ministry of Justice proposes to revise the control and supervisory powers of state bodies

Tashkent, Uzbekistan (UzDaily.com) -- In recent years, large-scale reforms have been carried out to ensure the smooth implementation of entrepreneurial activities and create favorable conditions for doing business.

In particular, the coordination of work on checking the activities of subjects was transferred to the Commissioner for the protection of the rights and legitimate interests of business entities, and these checks are carried out on the basis of the results of the "risk analysis" system.

In order to consistently continue the ongoing reforms and further strengthen the legal mechanisms for protecting business entities, the Ministry of Justice has developed a draft Decree of the President of the Republic of Uzbekistan "On measures to radically improve the quality and scope of state control in the field of entrepreneurship."

The draft document proposes the abolition of unnecessary control functions, the introduction of the "smart control" model.

In particular, the draft decree envisages the abolition of 33 controlling functions of 19 ministries and departments, the transfer of 14 unusual controlling functions of 7 ministries and departments to 8 responsible organizations, as well as the exclusion of 18 superfluous control functions from the powers of local government bodies.

Inspection by the Ministry of Internal Affairs of the work on the maintenance and repair of vehicles at vehicle service stations, control over the observance of certain trade rules by local government bodies, the presence of control cash registers and other powers - from among them.

Moreover, it is envisaged to conduct an experiment to exercise the authority of the tax authorities to issue collection of settlement accounts of business entities in banks and to suspend banking operations only on the basis of a court decision.

According to the draft Decree, an automated information system "Unified State Control" will be introduced, which will make it possible to conduct inspections, collect, process, analyze information completely in electronic form.

With the help of the automated information system "Unified State Control" it is proposed:

formation and open maintenance of a unified register of the controlling functions of state bodies and organizations;

integration of a unified system for electronic registration of inspections;

placement of a list of mandatory requirements and checklists by type of entrepreneurial activity;

remote verification of entrepreneurs by means of the “Electronic Inspector” module, etc.

On the basis of these measures, a map of corruption risks of the regulatory authorities will be formed, measures will be taken to minimize and curb them, and a rating of the regulatory authorities will be drawn up on their basis.

At the same time, the practice of sending a notification by the supervisory authority that made a decision to conduct an inspection will be introduced, which explains the rights and obligations of the parties, and provides for the parties’ liability for corruption offenses.

A legal experiment to test the new system will be conducted from 1 May 2021 to 1 January 2022 at the State Inspectorate for Supervision of Education Quality under the Cabinet of Ministers.

Taking into account the above, a list of mandatory requirements and checklists will be drawn up, which will be placed in the automated information system "Unified State Control":

at the first stage - until 1 December 2021, for 5 main activities (retail trade, public catering, food production, provision of non-state educational services and passenger transportation);

at the second stage - until 1 December 2022 - for 10 types of activities;

at the third stage - until 1 December 2023 - for all types of activities.
