Tashkent, Uzbekistan (UzDaily.com) - Contractual relations occupy a special place in the activities of business entities and the population.
The Ministry of Justice analyzed the legislative acts governing contractual relations, and in order to further create amenities in this area, an act of the President of the Republic of Uzbekistan was developed, providing for the following:
Elimination of artificial barriers when entering into contractual legal relations, in particular:
- removal of the established prohibition for commercial banks to offset payments with third parties for delivered goods (work, services);
- cancellation of the procedure for recourse by notaries of information about the presence of debt for utilities when notarized.
Ensuring the freedom of the parties in determining the terms of the contract, in particular:
cancellation of the requirement for advance payment of at least 15 percent of the cost of goods (works and services) under contracts concluded by economic entities with a state share in the authorized capital of 50 percent or more;
cancellation of a mandatory condition for determining an advance in contracts concluded between organizations for the production of agricultural and livestock products.
In accordance with the draft Decree, the aforementioned prepayment, as well as their size, will be determined in the terms of the contract by agreement of the parties.
Strengthening the protection of the rights of individuals and legal entities in some contractual and legal relations, in particular:
permission to individuals on the territory of the republic to provide and repay loans in foreign currency by notarization of loan agreements;
withdrawal of funds from bank accounts without a client's order is carried out only by a court decision or in cases stipulated by an agreement between the bank and the client;
the listing of property at electronic online auctions for the sale of property in the execution of judicial acts and acts of other bodies will be carried out free of all debts and prohibitions on property.
The conclusion of contracts with consumers in the field of utilities, energy supply, communication services, passenger and cargo transportation, developed by natural monopoly entities, will be carried out only after agreement with the state antimonopoly body;
It is proposed to establish the practice of concluding the following types of contracts only in electronic form:
contracts for training in the specialties of bachelor's and master's degrees;
contracting agreements with farms.
In order to create convenience when concluding contracts, it is proposed to place draft standard contracts on a special information portal of the Ministry of Justice for free use by the population and business entities.
