Tashkent, Uzbekistan (UzDaily.com) -- On 12 April 2022, at a meeting of the expert group of the Senate Committee on Judicial-Legal Issues and Anti-Corruption, the Law "On amendments and additions to certain legislative acts of the Republic of Uzbekistan in connection with the improvement of the management system of apartment buildings" was discussed.
The event was attended by senators, experts, specialists, chairmen of the standing commissions of the Jokargy Kenes of the Republic of Karakalpakstan, regional, district and city Kengashes of people’s deputies, representatives of the Youth Parliament and the media.
According to the experts of the Committee, following the results of a study of compliance with technical safety rules during the operation of more than 37 thousand apartment buildings, it was found that over the past five years, in more than 61 thousand cases, property owners have arbitrarily built structures on housing lands and adjacent territories.
However, when submitting applications to the courts for the forcible liquidation of illegally constructed illegal devices, the payment of a state fee is provided, therefore, when submitting materials of such content to the courts, a number of difficulties arise.
It was noted that the current legislation exempts homeowners’ associations from the payment of relevant tax payments for the improvement of a land plot adjacent to an apartment building and for the provision of other services to the population and the performance of work. However, it was noted that this benefit does not apply to the activities of managing organizations, which can lead to various disputes.
This Law, which was developed to fill these gaps, introduces appropriate amendments and additions to the Code of the Republic of Uzbekistan on Administrative Liability, the Tax Code of the Republic of Uzbekistan and the Law “On State Duty”.
The implementation of the Law will prevent violations in the maintenance and operation of apartment buildings, maintain the seismic resistance of engineering and technical communications and structural support parts of apartment buildings, and ensure safe living for the population.
The participants noted that the amendments to the Law will help ensure the financial stability of the governing bodies, create a competitive environment in the management system of apartment buildings, introduce innovations in the provision of quality services to the population, and prevent the emergence of numerous objections from property owners regarding the maintenance of the housing stock.
As a result of the meeting, recommendations of experts on this Law were prepared, which were submitted to the Committee on Judicial-Legal Issues and Anti-Corruption.
