International Arbitration Practice and Problems in Central Asia during COVID-19

Tashkent, Uzbekistan (UzDaily.com) -- The Court and the International Arbitration Center at the Astana International Financial Center, with the participation of the International Commercial Arbitration Court at the Chamber of Commerce and Industry of the Republic of Uzbekistan, organized an online webinar topic “International arbitration practice and problems in Central Asia during and after COVID-19” on 7 July 2020 in Nur-Sultan.

The webinar was attended by international arbitrators, lawyers, academics in the field of international commercial arbitration, representatives of the business community from Kazakhstan, Kyrgyzstan, Turkmenistan and Uzbekistan.

Presentations at the webinar were made by Shamaral Maychiev, chairman of the International Arbitration Court at the CCI KR on the topic “COVID-19 and new opportunities for the development of the MTS CCI KR” and Foziljon Otakhonov, chairman of the International Commercial Arbitration (Arbitration) Court at the CCI of the Republic of Uzbekistan. Doctor of Law, Acting Professor - “Prospects for the Development of International Arbitration and Arbitration Courts in Uzbekistan”.

Webinar moderator Christopher Campbell-Holt, registrar and chief of staff of the AIFC and IAC Courts in Kazakhstan, highlighted in detail issues related to arbitration and its advantages, such as the parties' ability to independently choose an arbitrator, promptness, efficiency, confidentiality of the dispute, high qualification and professionalism of arbitrators finality and enforceability of the decision.

At the webinar, it was brought to the attention of participants that the Arbitration Courts of the system of the Chamber of Commerce and Industry of the Republic of Uzbekistan for 2007–2020 examined 27,916 cases totaling 1.1 trillion soums, and the ICAC at the CCI examined 68 cases totaling 15.9 billion soums, and 4.6 million US dollars, 4.2 million Russian rubles and 39.8 thousand Euros. In the considered cases, companies of such countries as the Republic of Belarus, Germany, Denmark, Kazakhstan, China, Kyrgyzstan, the United Arab Emirates, Russia, Singapore, Turkey, Ukraine, and Uzbekistan participated as a plaintiff or defendant.

The event was held with the active participation of participants, and the speakers were asked questions arising in the activities of international arbitrations as an alternative dispute resolution during a pandemic.
