Tashkent, Uzbekistan (UzDaily.com) -- On 8 April 2019, Amnesty International appealed against physical violence and ill-treatment against former Prosecutor General Rashitjon Kadyrov, as well as other defendants were still subjected to high risk of torture.
The General Prosecutor’s Office investigated the criminal case against Rashitjon Kadyrov and others under the relevant articles of the Criminal Code, opened on 22 February 2018.
On 25 February 2018, Kadyrov was charged with participating in a criminal case as a defendant in extortion, taking bribes, as well as other official and economic crimes, and a preventive measure was chosen in the form of detention, the Prosecutor General’s Office said in a statement.
From the very beginning of the investigation, R. Kadyrov was granted the right to defense, the participation of a lawyer in all investigative actions, as well as the possibility of visiting him in private without any restrictions.
Given the age of Rashitjon Kadyrov and other defendants, during the preliminary investigation, their health status was under the constant control of medical institutions of the Ministry of Internal Affairs. During the consideration of the case in court, medical support is also provided and a separate special vehicle equipped with all the necessary medical equipment is allocated.
During the investigation, a forensic medical examination was carried out, according to which Rashitjon Kadyrov’s state of health does not interfere with his detention and no injuries were found.
It should be noted that lawyer A.Madjarov, acting on the basis of an agreement on legal assistance concluded with the law firm of Shcheglov and Partners in Moscow, applied for measures to ensure his participation as an attorney in a criminal case against P Kadyrov on 18 July 2018.
The investigating authorities immediately took measures to notify Rashitjon Kadyrov, who, in the presence of A. Madjarov, refusing his services on his own initiative, said that he was not under any physical or psychological pressure and he testified voluntarily. Rashidjon Kadyrov also noted that his law is represented by a different lawyer and he does not need to attract an additional lawyer.
Moreover, at the request of A.Madyarov, Rashitjon Kadyrov showed him his body, after which A.Madyarov made sure that there were no injuries. At the same time, Kadyrov asked A.Madyarov to contact his son A.Kadyrov and convey to him a request to compensate for the damage caused.
During the investigation, Rashidjon Kadyrov admitted his guilt in part, which indicates that he was given the opportunity to freely express his opinion on the charges and that there was no evidence of any pressure being applied to him to obtain confessions.
In addition, on 17 January 2019, during the court hearing, to the question of the presiding judge, R. Kadyrov testified that during the investigation he gave testimony voluntarily, which is enshrined in the minutes of the court session.
Currently, a criminal case against Rashitjon Kadyrov is considered by the court.
The Prosecutor General’s Office guarantees the adoption of all necessary measures to ensure the rights and freedoms of citizens involved in criminal cases.
