Guarantees for children’s rights strengthened

Tashkent, Uzbekistan (UzDaily.com) - The law "On introducing additions and amendments to some legislative acts of Uzbekistan" was discussed at the thirty-seventh plenary session of Oliy Majlis.

The law establishes administrative responsibility for leaving a child unsupervised on the territory of a foreign state. In particular, it stipulates that leaving a child who is a citizen of Uzbekistan unattended in a foreign country by the father, mother or person in loco parentis or by an accompanying person shall incur a fine of between 10 and 50 sizes of basic valuation size.

It also establishes criminal liability for committing the same act after an administrative penalty has been imposed or for failing to ensure the return to Uzbekistan of a child present in the territory of a foreign State within the period prescribed by the court. Thus, such an offence is punishable by correctional labour for up to three years or restriction of liberty for between one and three years, or deprivation of liberty for up to three years.

Another important feature. Under the amendments to the law on guarantees of rights of the Child, failure by a father or mother or person in loco parentis to supervise a child in a foreign country, that is, failure of the parents or person in loco parentis to meet their obligations to provide, raise and educate the child, shall entail liability in accordance with the law.

The law also amends the law on Preschool Education and Upbringing to increase from 25 to 50 the number of children who may be educated and cared for in non-State, family-based preschool educational organizations. The Law on the Procedure for Serving Administrative Detention was amended, according to which the authority to hear cases of administrative offences was transferred from administrative courts to criminal courts.

Thus, the Law "On introduction of additions and amendments to some legislative acts of the Republic of Uzbekistan" introduces necessary additions and amendments to 4 codes and 4 laws. Inherent to our people love to children, humanity, responsibility before society and the individual is reflected in our legal acts.

The law was approved by the senators.
