Tashkent, Uzbekistan (UzDaily.com) -- Resolution of the Cabinet of Ministers of the Republic of Uzbekistan “On measures to improve the management of apartment buildings and improve the provision of public services” was adopted on 1 February.

The document was adopted in pursuance of the Decree of the President from 19 June 2021 No. PP-5152 “On further improvement of the management system for apartment buildings”. They approved the provisions on the procedures:

formation and use of funds from the special account of the Fund for the Development of Housing and Communal Services of the Ministry of Housing and Communal Services (hereinafter referred to as the Fund) (1);

allocation of subsidies for the payment of mandatory contributions by owners of apartment buildings in need of social protection and included in the information system "Unified Register of Social Protection" (2);

formation and maintenance of an electronic register and rating of management bodies of apartment buildings (3);

holding an open competition to select a managing organization or a manager for managing apartment buildings (4).

Regulation (1) determines that the funds of the special account are accumulated on an off-budget personal treasury account of the Ministry of Finance opened with the Fund and are spent for the following purposes:

development of design estimates for repairs;

renovation of apartment buildings;

financing of other costs of the customer (design and survey work, examination, selection or tender, operating costs, and other costs associated with repairs).

It is strictly forbidden to spend funds from a special account for other purposes not provided for by this Regulation.

Regulation (2) establishes the procedure for granting a subsidy for the payment of a mandatory fee for the maintenance, use and repair of property, as well as for the improvement of a land plot adjacent to an apartment building. At the same time, subsidies are provided only to owners of apartment buildings in need of social protection and included in the information system "Unified Register of Social Protection". In accordance with Regulation (2), the amount of the subsidy to cover the mandatory fee should not exceed 30% of the basic estimated value and is transferred to the personal account of the respective owner in the management body of the apartment building.

According to Regulation (3), the management body of apartment buildings must register on the kommunal.uz website through a unified information system for identifying e-government users. After registration, the information provided is compared with the database of legal entities in the identification system and, in the absence of errors, is registered in the electronic register. The site compiles a list of unscrupulous management bodies based on negative feedback from the owners of apartment buildings. The list of unscrupulous governments will include governments that received more than 51% of negative reviews from owners of apartment buildings in the last financial year.

Regulation (4) establishes that the competition is held for the right to conclude contracts for the purpose of managing one or more apartment buildings. The competition is based on the following principles:

creation of equal conditions for participation in the competition;

prevention of corruption;

fair competition;

freedom to receive information about the competition.
