Tashkent, Uzbekistan (UzDaily.com) -- The Ministry of Justice of Uzbekistan has developed draft laws on preventing conflicts of interest and posted them on the regulation.gov.uz website for public discussion. This is reported by the Public Relations Department of the Ministry of Justice.
The bills envisages the following:
- related persons - legal entities whose shares of the authorized fund (authorized capital) (with the exception of up to 10 percent of shares in public circulation) are owned or members of the management body and supervisory board by employees of state organizations and (or) their relatives;
– the tasks of the authorized state bodies are defined in the field of preventing conflicts of interest in the activities of state bodies, namely the Anti-Corruption Agency, as well as ethics commissions, personnel departments and internal anti-corruption structures formed in state organizations;
- the procedure for disclosing information about a conflict of interest by employees of a state organization is determined by:
declaration of information about a conflict of interest;
reporting real conflicts of interest.
It is also stipulated that close relatives and related persons of an employee of a state organization, upon entering into legal relations with the organization in which the employee works, must notify in writing or electronic form of a conflict of interest.
In addition, the legal consequences of violation of the conflict of interest requirements are determined. In particular:
non-disclosure of a conflict of interest or other grounds for bringing to disciplinary or other liability established by law for its non-regulation;
Failure to notify employees of state bodies and organizations in the manner prescribed by law of the existence of a real conflict of interest entails a fine of three to five basic calculated values (repeated case - from five to ten basic calculated values).
And also, the failure by an official to take measures to resolve the conflict of interests in cases of conflict of interest that have become known to him, entails the imposition of a fine from five to ten basic calculated values (repeated case - from ten to fifteen basic calculated values);
– Authorized body in the field of combating corruption, that is, the Anti-Corruption Agency is entrusted with the task of drawing up administrative protocols;
- the decision and agreements concluded with the assumption of a conflict of interest are recognized by the courts as invalid, and the profit received from such agreements will be transferred to the state.
– Mechanisms for identifying conflicts of interest are being created.
It is expected that the adoption of these bills will prevent the commission of corruption offenses by civil servants in state organizations and will positively affect the position of Uzbekistan in 3 indicators in the field of combating international corruption.
When developing draft laws, the practices of foreign countries (Czech Republic, Latvia, Croatia, Georgia, Canada, Moldova, etc.) with advanced experience in this area were studied.
