Are the powers of khokims being reduced?

Tashkent, Uzbekistan (UzDaily.com) -- At the regular meeting of the Legislative Chamber of the Oliy Majlis, held on 21 August 2020, the deputies discussed in the first reading the draft law of the Republic of Uzbekistan “On amendments and additions to some legislative acts of the Republic of Uzbekistan in connection with the further strengthening of guarantees of rights and legitimate interests of the owners”.

In accordance with the new practice introduced in the lower house of parliament, a representative of the entity exercising the right to legislative initiative in parliament made a presentation for the adoption of the relevant bill in the first reading, conceptually substantiated it and defended it before the deputies. Deputy Chairman of the Supreme Court B. Isakov spoke on this issue.

As it was noted, the draft law reflects the norms on establishing a ban on the seizure of land plots by khokims, limiting their powers to terminate the right to own and use a land plot, as well as leasing a land plot.

Also, by the bill, the power to seize land plots for state and public needs, as well as for the implementation of investment projects, is transferred to the Jokargu Kenes of the Republic of Karakalpakstan, Kengashes of people’s deputies of the regions and the city of Tashkent.

It is envisaged to consolidate in the draft law the norms for preventing the revision and cancellation of the results of denationalization of enterprises (organizations) and privatization of property.

At the same time, appropriate amendments and additions are being made to the laws of the Republic of Uzbekistan "On local government power", "On the protection of private property and guarantees of owners’ rights" and the Land Code.

The people’s representatives stressed that the adoption of this draft law will protect the rights of owners from unjustified deprivation of their ownership of their property. In addition, full compensation for damage caused to owners in connection with the seizure of land plots (including by the state) will serve to increase the owners’ confidence in the state and its bodies.

After active discussions, the bill was adopted in the first reading.
