Alimony debtors to be banned from driving

Tashkent, Uzbekistan (UzDaily.com) -- Uzbekistan intends to temporarily restrict alimony debtors’ rights to drive a vehicle.

This is envisaged by the draft law, which was published for discussion. The document proposes to amend the Code of Administrative Responsibility, as well as the law "On the execution of judicial acts and acts of other bodies."

According to the bill, a decision to temporarily restrict the debtor’s right to drive a car can be made if a citizen does not comply with the requirements of a writ of execution or a court document on time for unjustified reasons.

The state executor submits to the court a temporary ban on issuing a license to the debtor, as well as the suspension of previously issued licenses, permits and special rights.

The document notes that the deprivation of a driver’s license or license will be valid until the debtor pays alimony. 

At the same time, the temporary restriction of the debtor’s right to drive vehicles or engage in licensed activities is not applied in case of confiscation of property sufficient to enforce a court decision.

Also, this measure is not taken if the imposition of such a restriction deprives the debtor of the main and legitimate source of livelihood.

This rule will not apply to debtors who are disabled people of the first and second groups.

This rule does not apply if the debtor is given the opportunity to defer payment or installment payment in order to fulfill the requirements of the writ of execution, as well as when concluding a pledge agreement that secures the obligation to pay alimony.

The decision of the executor on the temporary restriction of the right of the debtor to drive a vehicle may be appealed or protested.

Driving a car by a person with a limited driving license, as well as transferring the right to drive to such a person, entails a fine in the amount of five times the base calculated amount (currently 1.35 million soums).
