Tashkent, Uzbekistan (UzDaily.com) -- Resolution of the President “On measures to implement the project for the modernization and management of the Samarkand international airport on the basis of public-private partnership” was adopted.

The Resolution approved the State Support Agreement between the Ministry of Finance and FE LLC Air Marakanda (hereinafter referred to as the Private Partner), signed on 11 April 2022.

The document determines that new facilities built by the Private Partner in accordance with the PPP Agreement:

belong to the Private Partner on the basis of ownership – during the term of the PPP Agreement;

after the expiration of the Public-Private Partnership Agreement or in case of its early termination, they are transferred exclusively to Uzbekistan Airports JSC (Public Partner) on the basis of ownership.

Also, in accordance with the Agreement on State Support and the Agreement on Public-Private Partnership, during the period of their validity, it is allowed to link prices for goods (works, services) sold by the Private Partner in the territory of Uzbekistan to foreign currencies.

The resolution established that:

property received in accordance with the PPP Agreement by the Private Partner from the Public Partner, as well as received by the Public Partner from the Private Partner after the expiration of the Agreement or in case of its early termination, is recognized as property received under the concession agreement in accordance with the law;

fixed-form payments made by a Private Partner to a Public Partner to repay a loan raised at the expense of the Japan Bank for International Cooperation for the modernization of Samarkand International Airport are not subject to taxation.
