A meeting of the Senate Committee on Judicial and Legal Affairs and Anti-Corruption was held

Tashkent, Uzbekistan (UzDaily.com) -- A meeting of the Senate Committee on Judicial and Legal Affairs and Anti-Corruption was held.

The meeting was attended by members of the Senate, chairmen of the standing commissions of the Jokargy Kenes of the Republic of Karakalpakstan, regional and Tashkent city Kengash of people’s deputies, members of the expert group under the Committee, senior officials of the Youth Parliament, relevant ministries and departments, as well as media representatives.

Issues to be discussed at the next plenary session of the Senate were preliminary considered at the meeting. In particular, the Law of the Republic of Uzbekistan “On amendments and additions to some legislative acts of the Republic of Uzbekistan in connection with the improvement of the management system of apartment buildings” was discussed.

As noted, in the current legislation, homeowners’ associations are exempt from certain tax payments for the provision of services for the improvement of a land plot adjacent to an apartment building, as well as for the provision of other services to the population and the performance of work, however, these benefits are not applied in the activities of managing organizations, which causes controversy.

The law, developed in order to eliminate these gaps, introduces appropriate changes and additions to the Code of the Republic of Uzbekistan on administrative responsibility, the Tax Code of the Republic of Uzbekistan and the Law "On State Duty".

The implementation of this Law will make it possible to prevent violations in the provision of public services, including in the maintenance and operation of apartment buildings, to preserve engineering and technical communications in apartment buildings and the ability to maintain structural parts of the house, as well as earthquake resistance, which will create conditions for the safe living of residents .

At the meeting of the Committee, the Law of the Republic of Uzbekistan “On Amendments and Additions to Certain Legislative Acts of the Republic of Uzbekistan in connection with the adoption of the Law of the Republic of Uzbekistan “On International Commercial Arbitration” was also discussed.

It was noted that in order to ensure the implementation of the norms of the Law “On International Commercial Arbitration”, appropriate amendments and additions are being made to the Economic Procedure Code of the Republic of Uzbekistan and the Law of the Republic of Uzbekistan “On State Duty”.

Thus, an addition is made to the Economic Procedure Code, according to which the judge, due to the fact that during the initial consideration of the case he participated as an arbitrator of the Arbitration Court, cannot participate in the re-examination of this case. Also, this Code is supplemented by new rules providing for the assignment of cases related to arbitration proceedings to the jurisdiction of economic courts, the abolition of interim measures taken by the economic court based on the results of consideration of an application for interim measures on a claim pending in the Arbitration Court.

In addition, it was noted that amendments are being made to the Law “On the State Duty” establishing the grounds and amounts for the collection of the state duty payable on applications to challenge the arbitral award.

Further, the senators discussed the report of the Prosecutor General of the Republic of Uzbekistan on the activities of the prosecution authorities in 2021. 

During the discussion, it was noted that the prosecution authorities of the Republic of Uzbekistan carried out certain work on comprehensive support and social protection of the population, including needy families in the context of the coronavirus pandemic, establishing effective control over the implementation of laws to maintain the stability of economic sectors, and prevent offenses and crimes.

As noted, the prosecution authorities contributed to the repayment of overdue wage arrears and other payments to 4,187 citizens in the amount of 7 billion soums. In addition, theft of wages and equivalent payments in the amount of 29 billion soums was revealed, and appropriate measures were taken in this direction.

Violations of legislation in the field of employment of the population have been eliminated, while about 170 thousand citizens, including 46,802 young people and 34,804 women, were employed with the support of the prosecutor’s office.

Also, in order to improve the conditions of families in need, 152,598 families living in prosecutorial sectors were provided with comprehensive assistance. 146,365 families were excluded from the lists of families in need by decisions of local Kengashes.

In order to support business entities and eliminate factors hindering their activities, practical assistance was provided to more than 29,000 entrepreneurs and investors. In particular, assistance was provided to 481 entrepreneurs and investors in the allocation of premises to them, 3,532 in the allocation of land, 1,496 in the issuance of licenses and permits, 9,243 in the allocation of loans.

269,906 appeals received from individuals and legal entities were resolved directly in the prosecutor’s office. 312,386 citizens were admitted, measures were taken to solve their problems.

At the same time, shortcomings admitted by the prosecutor’s office were noted at the meeting.

In particular, infectious diseases and infant mortality have increased significantly due to health problems, including reproductive health, maternal and child health.

The tasks of supporting women and youth have not been adequately fulfilled, as a result of which 750,050 young people and 856,595 women are not provided with employment in the republic. As a result, 27,931 young people and 9,759 women committed crimes.

Also, due to the untimely provision of practical assistance to entrepreneurs, 46,985 business entities ceased their activities, and 10,258 ceased their activities for various reasons.

During the discussion, the necessary recommendations were given to eliminate these problems.

Appropriate decisions of the Committee were made on the issues discussed at the meeting.
