A Law strengthening citizens’ rights guarantees and judicial independence approved

Tashkent, Uzbekistan (UzDaily.com) — During the fifth plenary session of the Senate of the Oliy Majlis of the Republic of Uzbekistan, senators reviewed and approved the Law "On Amendments and Additions to Certain Legislative Acts of the Republic of Uzbekistan Aimed at Strengthening Judicial Guarantees and Citizens’ Rights and Freedoms in Connection with the Adoption of the New Edition of the Constitution of the Republic of Uzbekistan."

This legislative initiative represents a logical continuation of the sweeping reforms undertaken in the country in recent years. These reforms are focused on improving the judicial system, enhancing the transparency and objectivity of court rulings, and reinforcing the guarantees for protecting the rights, freedoms, and legitimate interests of both citizens and entrepreneurs.

Among the key amendments introduced by the Law is the principle of the presumption of innocence. Changes to the Criminal Procedure Code explicitly state that a suspect, accused, or defendant is not required to prove their innocence. Additionally, the right to remain silent at any stage of legal proceedings is formally enshrined.

The law also strengthens protection against self-incrimination, stipulating that an admission of guilt alone cannot serve as sufficient evidence for a conviction. Furthermore, witnesses now have the right to refuse to testify against themselves or their close relatives.

Judicial independence has been further reinforced, as the law mandates that the removal of a judge from a case, the suspension of their powers, or their transfer to another position can only occur in strict accordance with the law. Any interference in judicial activities is explicitly prohibited, and judges are not accountable to external bodies.

Additionally, the powers of the Supreme Court have been refined, clarifying that its legislative initiative is now limited strictly to matters within its jurisdiction.

The adoption of this law marks another step toward strengthening judicial independence, ensuring the supremacy of the Constitution, and providing solid legal guarantees for the protection of citizens’ rights and freedoms. It also aims to improve the quality of justice and bolster public trust in the judiciary.

"This law is a crucial step in implementing constitutional principles aimed at protecting human rights and ensuring fair justice," noted participants of the session.

Following discussions, the Senate unanimously approved the law, which will now proceed for further consideration.
