Uzbekistan Proposes Extending Spousal Reconciliation Period

Tashkent, Uzbekistan (UzDaily.com) — Uzbekistan has proposed amendments to the Family Code to extend the reconciliation period for couples undergoing divorce. The draft law has been posted on the national regulatory discussion portal.

The initiative comes from the Committee on Family and Women’s Affairs. The draft notes that current legislation does not fully consider key aspects of family relationships. In particular, divorces processed through civil registry offices often do not examine the real causes of conflict or possibilities for resolution, making the procedure formal in many cases.

The amendments focus especially on the reconciliation period in judicial proceedings. Currently, courts may grant up to six months for reconciliation, but the authors of the draft consider this period insufficient. The proposal would increase the maximum period to one year.

Changes also include updating the notification process to relevant commissions, shifting from the current “within three days” rule to a mechanism using electronic government services.

The draft further addresses the protection of children’s rights. Article 44 would clarify that the court, when granting a divorce, must determine which parent the minor children will reside with and ensure their place of residence. It also establishes clear rules for communication between children and the parent living separately.

Alimony provisions are also affected. Article 107 proposes that child support for children in institutions be transferred to bank accounts opened in the child’s name, under the supervision of guardianship authorities.

Additionally, Article 122 would regulate the filing of divorce applications for couples married less than one year, except in cases involving domestic violence.

The proposed changes aim to provide a more comprehensive legal framework for family relations and strengthen the protection of children’s rights during divorce.
