Tashkent, Uzbekistan (UzDaily.com) - These days, a delegation of Uzbekistan, led by the Minister of Justice, Ruslanbek Davletov, is visiting the Netherlands.
The main goal is to complete the procedure for Uzbekistan to join the Hague Conference on Private International Law.
On 4 March, Uzbekistan officially became a member of this organization. To date, the Hague Conference on Private International Law has brought together 83 participants (82 states and the European Union). Now the number of its members after the accession of the Dominican Republic and the Republic of Uzbekistan has reached 85.
Why did Uzbekistan become a member of this organization and what will it give to our people?
In the context of increasing globalization, public relations of a private law nature are increasingly going beyond national legislation. In this connection, legal conflicts arise, complicated by a foreign element, conflict situations or various kinds of inconveniences for citizens. For example, there are many cases where a country has recognized a document issued by another state, the adoption of a child born in another country, or the birth of a child abroad. The solution of such legal issues without conflicts and excessive bureaucracy is useful both for a person and for states. For this reason, many countries of the world reach mutual agreements, cooperate through various international legal documents and international organizations. Under the auspices of the Hague Conference on Private International Law, about 40 conventions are concluded in three main categories:
- international protection of children, family and property relations;
- international legal cooperation and dispute resolution;
- international commercial and financial law.
Unification of international private law is an urgent task for Uzbekistan. Because the rapid growth of migration, an increase in the number of civil disputes in various sectors complicated by a foreign element, entail numerous issues that need to be addressed urgently.
Uzbekistan’s membership in the Hague Conference will ensure the country’s participation in the unification of international family and private law, further development of the legal system, taking into account world standards, increasing the effectiveness of protecting the rights and interests of citizens of the state abroad.
The Hague Conventions are not an innovation for Uzbekistan, so far our country is already a party to the three Hague Conventions. In particular, the Convention on Civil Procedure (1954), the Convention on the Abolition of the Requirement to Legalize Foreign Official Documents (1961), the Convention on the Civil Aspects of International Child Abduction (1980).
What will the Hague Conference on Private International Law give us?
The membership of Uzbekistan in Hague Conference on Private International Law will undoubtedly entail a number of significant changes in national legislation, which will serve as a simplification of international legal assistance and favorable interaction within the framework of assisting citizens in their international activity providing wide opportunities. Including:
The system of international legal assistance will be simplified.
More opportunities will be provided to citizens in need of international legal assistance.
International civil disputes will be resolved efficiently, quickly and at minimal cost.
This will have a positive impact on national law and enforcement.
A new impetus to the development of the science of private international law in Uzbekistan.
At the same time, the activities of Uzbekistan in this international organization as a full member will allow us to reflect our national interests in future international documents.
