Uzbekistan develops draft law “On mandatory insurance of civil liability of transporters”

Tashkent, Uzbekistan (UzDaily.com) -- Uzbekistan developed a draft law “On mandatory insurance of civil liability of transporters”.

The document was developed by Ministry of Finance and other several ministries and departments of Uzbekistan. The draft law was discussed at the session of Adolat Party of the Legislative Chamber of Oliy Majlis of Uzbekistan.

The main idea of the draft law is to guarantee compensation for damage via insurance of the civil liability of the transporters.

In line with the Civil Code of Uzbekistan, the transporters are responsible for damage to health and life of passengers, their property, as well as loss and damage to luggage.

National legislation has no legal document, which regulates civil liability for damage to health of passengers and their property.

At the same time, insurance for damage to health of passengers is ensured with the law of Uzbekistan “On mandatory personal insurance of passengers of air, railway, internal water and automobile transport of general use”. The study of the law shows that it does not meets modern requirements.

New draft law will regulate relations in mandatory insurance of the civil responsibility of transporters for damaging health, life and property of passengers. The document clearly sets requirements to objects and subjects of mandatory insurance, as well as to transporters and insurers.

Adolat party also considered a draft law “On introduction of changes and amendments to some legislative acts of Uzbekistan in connection with adoption of the law “On mandatory insurance of civil liability of transporters”.

The document will abolish “On mandatory personal insurance of passengers of air, railway, internal water and automobile transport of general use”.

It also abolishes article 110 of the Air Code of Uzbekistan, article 28 of the law “On automobile transport” and article 25 of the law “On railway transport”. It also amends the law “On mandatory insurance of the civil liabilities of vehicle owners”.

MPs from Adolat party noted that the document serves to protection of interest of vehicle owners and passengers, as well as development of insurance market and transport infrastructure.
