Tashkent, Uzbekistan (UzDaily.com) -- The prosecutor general’s office studied the facts indicated in the article under the heading “In the center of Tashkent, residents demand that the site be returned to children. It was demolished by the developer”.
In accordance with resolution No. 96 of the khokim of Tashkent city dated 9 February 2015, a private entrepreneur is allowed to repair buildings located at Mirabad district, 24 Amir Temur Avenue, as well as additional construction of a 0.04 hectare administrative and public services complex owned by territory.
Due to a contradiction to the requirements of the legislation on urban planning, this resolution was canceled on the basis of a protest from the prosecutor’s office in Tashkent.
At the same time, the decision of the administrative court of the Chilanzar district from 13 November 2018 also satisfied the statement of the partnership of private homeowners "Baraka Communal", and the above decision of the city khokim was declared invalid.
After that, the construction work carried out on the site of the children’s playground was suspended, but the territory was not restored to its previous state.
The Prosecutor’s Office of Mirabad district in the interests of citizens on 16 October 2019 submitted a statement of claim to the Tashkent Interdistrict Economic Court to impose on the private entrepreneur the obligation to dismantle the structure and restore the territory to its previous state.
This issue will not be removed from the agenda until a court decision is made and a lawful decision is made on it.
