Tashkent, Uzbekistan (UzDaily.com) - The Government resolution defined the procedure for issuing a protection order to women who have suffered from oppression and (or) violence.
A security order is a document that provides state protection to a victim of harassment and violence, entailing the application of measures of restraint against a person or group of persons who harass women or have committed violence against them.
A security order is issued by the (senior) inspector for the prevention of a stronghold of the internal affairs bodies.
The following are grounds for issuing a security order:
- treatment of the victim of oppression and violence;
- messages from individuals or legal entities, including those distributed through the media and (or) social networks;
- direct identification by employees of authorized bodies and organizations of cases of the commission or attempt to commit harassment or violence;
- materials of state bodies and other organizations.
The personal data of persons reporting harassment and violence, as well as women who have suffered from harassment and violence, are protected in the manner prescribed by law.
Inspectors for the prevention of internal affairs bodies consider appeals and messages received from duty units within 24 hours and in the course of consideration:
- conduct a conversation with the victim and the perpetrators of violence, as well as other persons;
- studies the lifestyle of the victim and the person who committed the violence, the causes and conditions of the occurrence of harassment and violence;
- implements measures for social rehabilitation and social adaptation of the victim and the perpetrators of violence.
Prevention inspector based on the results of studying appeals and messages:
- upon detection of cases of harassment and violence - draws up a protection order;
- with the consent of the victim, notifies self-government bodies and other authorized bodies of the issuance of a protection order from persons who committed violence;
- in the absence of signs of harassment and violence, determines the appropriate measures, as well as draws up an act with the participation of the chairman, secretary, specialist on working with women and strengthening spiritual and moral values in families of citizens ’gatherings,
- when identifying signs of a crime under the Criminal Code, at the same time as considering the issue of issuing a protection order, sends the case file to the appropriate law enforcement body to resolve the issue of criminal liability.
An application for the issuance of a protection order to victims under the age of 18 is considered with the participation of their legal representative or a representative of the guardianship authority.
A security order consists of three parts:
- the first part (original) after filling out is given to the victim;
- the second part (copy) is issued to the perpetrators of violence;
- The third part remains with the inspector for prevention.
Validity of a protection order is up to 30 days (can be extended by an additional 30 days).
A security order establishes the following restrictions:
- a ban on harassment and violence;
- a ban on communication between the parties (in workers and educational institutions indirect contact is allowed);
- a ban on finding parties in the same room;
- impose obligations on the perpetrator (treatment of the victim, compensation for material and moral harm);
- restriction or prohibition of the right of the rapist to store and carry weapons (except for service weapons).
