Supreme Court Clarifies Acquittal of “Star Med Centr” Doctor

Tashkent, Uzbekistan (UzDaily.com) — The Supreme Court of Uzbekistan has issued an official statement regarding the case of Alijon Khisamov, an otolaryngologist at the private clinic Star Med Centr, who was acquitted by the Appellate Panel for Criminal Cases of the Tashkent City Court.

In its ruling of 29 November 2024, the Uchtepa District Criminal Court had found Khisamov not guilty under Part 2 of Article 117 of the Criminal Code (“Leaving in Danger”) but convicted him under Part 3 of Article 116 (“Improper Performance of Professional Duties”), sentencing him to five years of restricted freedom and banning him from practicing medicine for two years.

During the appeal hearing, the presented evidence was reviewed, and it was determined that there were no reliable or objective grounds to hold Khisamov criminally liable. The court concluded that the factual circumstances cited in the initial verdict did not reflect reality.

Specifically, it was established that the medical examination and instrumental diagnostics of patient Farrukh Mannopov had been carried out in accordance with established standards. Expert opinions and specialist testimonies confirmed the absence of cranial trauma or other injuries that could have caused the patient’s death. Furthermore, two internal reviews by the Ministry of Health determined that Khisamov had not committed any errors during the surgery that might have led to a fatal outcome.

On 22 July 2025, the Appellate Panel for Criminal Cases of the Tashkent City Court overturned part of the initial ruling and fully acquitted Alijon Khisamov on the basis of Article 83 of the Code of Criminal Procedure (“Grounds for Rehabilitation”).

The Supreme Court noted that dissatisfied parties have the right to challenge this verdict through supervisory review before the Tashkent City Court in accordance with Article 510 of the Code of Criminal Procedure.
