Indeed, one of the main criteria of the democratic state is the separation of powers into legislative, executive and judicial branches, existence of the system of checks and balances between them. All of these are basic condition to prevent the concentration of power in one branch and to ensure a democratic development, social stability, the rule of law and the balance of interests.
On this basis, the members of factions and deputy groups of our Party in local representative bodies jointly established a system of strong deputy, parliamentary control over the implementation of legislation in the field, which today is used in the implementation of policy goals and objectives of the party. The party works closely with civil society institutions, the Chamber of Commerce and Industry, the Council of the farmers of Uzbekistan and other organizations.
In particular, possibility of MPs control is efficiently used in achieving several programme goals of the party such as creation of favorable conditions for the accelerated development of small business, private entrepreneurship and farming, prevention of unlawful interference of the government and regulatory authorities in the activities of economic entities. In the first half of this year, members of the faction in parliament and UzLiDeP deputies at local councils held a total of 141 control and analytical activities. As a result, the sessions of the representative bodies, meetings of the standing committees and Deputy Groups considered reports of the 132 officials and directed 751 MPs requests.
For example, the Committee of the Legislative Chamber of Oliy Majlis on industry, construction and trade conducted control-analytical activities on studying execution of the laws on protection of interests of the proprietors in Andijan and Surkhandarya regions.
It is worth noting that in the course of control and analytical activity special attention is paid to execution of the decree of the President “On measures on ensuring reliable protection of private property, small business and private entrepreneurship, removal of barriers to their rapid development”, the law “On protection of private property and guarantees owners’ rights”, “On guarantees of freedom of entrepreneurial activity”, and “On appeals of individuals and legal entities”.
As a result of systematic measures, it was revealed that in both region the effective work for the implementation of the legislation on protection of the rights and interests of private property owners were carried out. The programme on measures on expanding and deepening reforms in the economy of Uzbekistan for 2011-2015, approved by the President of Uzbekistan on 7 January 2011, determined holding the “Day of Entrepreneurs” by the responsible organizations. In this regard, effective mechanism of consideration of appeals in state bodies works. It is noteworthy that state bodies and other organizations regularly conduct surveys on intervention of the state and controlling bodies into the activities of businesses.
According to the figures, in last five years share of small business in the GDP of Surkhandarya region rose from 68.8% to 74.5%. Some 1,304 new small and private businesses were created in 2014. In the result, over 37,000 new works were created.
As of 1 January 2015, number of small businesses reached 22,802 in Andijan region, which helped to create 71,400 new jobs. Share of small businesses in exports of the regions made up 27% in 2014.
The justice bodies made 38 claims for compensation for damages, caused to the small businesses by actions of the state bodies and officials in Surkhandarya region in 2013. The courts ruled to recover over 560 million soums in interest of businesses. Some 61 claims were submitted to courts in 2014 and the businesses received about 1.089 billion soums as compensations. In the first quarter of 2015, 33 claimes were submitted and currently considered by the courts.
The justice bodies carried out inspections of 98 state and controlling bodies in Andijan region. In the result, 203 introductions were submitted and 16 officials were attracted to administrative responsibility, as well as 2 persons – to criminal responsibility. In the result of adopted measures, 64 decisions, adopted in line with the violation of legislation, were abolished, including three decisions of the state bodies in places and 61 decisions of the controlling bodies.
In the result of controlling-analytical activities in the Committee of the Legislative Chamber of Oliy Majlis of Uzbekistan on industry, construction and trade, the reports of the officials of the administrations of Surkhandarya and Andijan regions in these directions were considered. The proposals made to eliminate shortages.
Any activities cannot be without flaws. However, you must learn lessons from this in a timely manner to eliminate them. This is only way to achieve development.
