Senators rejected the Law on citizens participation in the protection of public order

Tashkent, Uzbekistan (UzDaily.com) -- Another issue considered on the agenda of the fifth plenary meeting of the Senate of the Oliy Majlis was the Law of the Republic of Uzbekistan “On the participation of citizens in the protection of public order”.

It was especially noted that most of the norms of the Law do not regulate real life relations, a significant part of them are not fully defined, and there are no mechanisms for implementing the planned measures.

In particular, article 7 of the Law establishes that citizens, when participating in the protection of public order, cooperate with bodies and institutions directly involved in the prevention of offenses. However, the law does not reflect their powers, rights and obligations.

Issues related to the register of persons participating in the protection of public order and the activities of the bodies that carry it out are not provided. Article 8 of the Law does not fully reflect restrictions on the participation of citizens in the protection of public order.

The Law does not set out forms relating to the formation by citizens of public structures and participation in their activities in order to promote the protection of public order, as well as individual and collective participation in the protection of public order.

The senators noted that some articles of the Law did not disclose issues directly related to the rights of citizens, but enshrined the implementation by state bodies or in the manner prescribed by law, as well as the regulation of the norms of the Law, which should have direct effect, or their absence in the Law, could pursue departmental interests and short-term goals.

In addition, the regulation of public relations in most cases by-laws leads to a decrease in the effectiveness of laws, the absence of laws of direct action, a fragmented resolution of issues without an integrated approach.

The norms of the Law that are not fully disclosed, the lack of mechanisms for their implementation can lead to legal conflicts and abuse, strengthen bureaucratic procedures, and make decisions bypassing the law.

With this in mind, senators decided to reject the Law.
