Senate of Uzbekistan approves amendments to the system of enforcement of judicial acts

Tashkent, Uzbekistan (UzDaily.com) — The sixth plenary session of the Senate reviewed the law "On Amendments and Additions to Certain Legislative Acts of the Republic of Uzbekistan Aimed at Improving the System of Enforcement of Judicial Acts and Acts of Other Authorities."

Senators emphasized the relevance of adopting this normative act, highlighting existing problems in the system of compulsory enforcement. Among these issues were the lack of the ability to electronically generate enforcement documents, the automatic distribution and transfer of recovered funds without the involvement of state enforcement officers, and the absence of a mechanism to protect the minimum guaranteed income of citizens from seizure.

The necessity to empower enforcement officers with the right to use mobile video surveillance tools and the disproportionate nature of fines for violations of legislation in this area were also noted.

The adopted law is aimed at addressing these and other issues. In particular, it establishes that the enforcement document must include the personal identification number of an individual claimant and the taxpayer identification number for legal entities.

The law also stipulates that enforcement cannot apply to the funds of individual debtors in amounts up to half of the minimum wage, held in accounts or deposits at banks and other credit institutions.

State enforcement officers are granted the right to use mobile video surveillance tools while carrying out enforcement actions. Corresponding amendments have been made to the Civil, Economic Procedural Codes, and the Code of Administrative Litigation.

Additionally, the fines prescribed in Article 198² of the Code of Administrative Responsibility for violations of the legislation on the enforcement of certain types of judicial acts and acts of other authorities have been increased.

Senators noted that this law will ensure more reliable protection of the rights and interests of citizens, improve the efficiency and transparency of enforcement procedures, and reduce the influence of human factors.

Following the discussion, the law was approved by the senators.
