Seizure of land and demolition of real estate to be carried out in three stages
Tashkent, Uzbekistan (UzDaily.com) – Presidential order “On additional measures on ensuring reliable guarantees of property rights of citizens and businesses” was adopted in Uzbekistan.
According to the order, starting from 5 August 2019, work on the seizure of land and the demolition of real estate of citizens and businesses will be carried out in 3 stages:
- package materials in areas, where the planned demolition, shall be submitted by the khokims to the Cabinet of Ministers;
- the Cabinet of Ministers is preparing conclusions according to urban planning requirements and financial calculations;
- the conclusion is submitted to the Prime Minister for consideration and decision.
The document also approved the structures of the Republican coordination working group and territorial working groups on inventory of the size of the damage caused to citizens and business entities during withdrawal of the parcels of land.
It also approved a list of responsible persons attached to the regions to assist in the inventory and “road map” to eliminate the shortcomings made during the inventory and their coverage.
The working group on carrying out inventory is entrusted:
- carrying out inventory of the damage caused to citizens and business entities, with departure on places, determination of their real and fair size, according to market value, according to the legislation;
- establishment of specific sources of compensation for damage, if the harm is caused as a result of an illegal decision of an official –recovery from these officials in the order of recourse;
- development of concrete proposals for the adoption of measures of responsibility to the guilty officials and further improvement of the legislation.
Within a month, the government will make a decision envisaging:
- implementation of state programs, major investment and other projects, taking into account the opinion of the majority of the region's population;
- selection of the land plots occupied, first of all, by objects of dilapidated and emergency housing stock, including unused, with public discussions with owners of the real estate objects located in them at withdrawal of the land plots;
- obtaining the consent of the owners of residential and non-residential real estate located in the territory, and the conclusion of a written agreement on compensation for losses caused by the seizure of land, for the khokims decision on the seizure of land.
A draft law on strengthening the liability of officials for causing damage to owners in connection with the illegal seizure of land will be developed.
This procedure will be in force until the adoption of a government resolution establishing the procedure for seizure of land plots specified in the order and compensation for losses caused to owners.
