Rashitjon Kadirov was sentenced to 10 years in prison

Tashkent, Uzbekistan (UzDaily.com) – On 26 June 2019, Tashkent City Court sentenced the former Prosecutor General of the Republic of Uzbekistan Rashitjon Kadirov and others (13 persons in total).

According to the court verdict, Rashitjon Kadirov, occupying the post of Prosecutor General of the Republic of Uzbekistan in 2000-2015, committed a number of grave and especially grave crimes by prior agreement with a group of persons occupying senior positions in the prosecutor’s office and other law enforcement agencies, namely Mirzaev M., Fayziev Zh., Sunnatov U., Pulatov R., Musashaykhov A., Khurramov U., Gaipov Yu., Mirzaev A., Mirzaeva M., as well as citizens Kosimov S., Ikramov A., Akhmedjanov Kh., expressed in accepting bribes (Article 210 part 3 clause “A” of the Criminal Code of Uzbekistan), incitement to pay bribes (article 28.211 part 3, paragraph a) of the Criminal Code of Uzbekistan, fraud (article 168 part 3, paragraph a) of the Criminal Code of the Republic of Uzbekistan, willfully evading taxes and other obligatory payments (article 184 Part 3 of the Criminal Code of Uzbekistan), interfering with the investigation or resolution of court cases (article 236 part 2 of the Criminal Code of Uzbekistan), legalization of income received from criminal activities (article 243 of the Criminal Code of Uzbekistan) and other crimes against the functioning of government bodies, administration and public associations.

In a closed court hearing, held in accordance with the requirements of Article 19 of the Code of Criminal Procedure of the Republic of Uzbekistan, as well as the Law on the Protection of State Secrets, all arguments of the defendants ’testimony were thoroughly checked, the testimony of about 200 witnesses was examined, and the conclusions of expert examinations and official checks and other evidence collected in the case, for their legality and validity.

For the crimes committed by R. Kadirov was found guilty and sentenced for 10 years in prison and will have to pay a fine of 500 minimum wages.

Sunnatov U. was sentenced for 19 years old, Mirzaev A. - 15 years, Khurramov U. - 14 years, Fayziev Zh. 13 years, Musashayhov A. 13 years in prison.

The other persons involved in the criminal case were also punished within the norms of the law in proportion to their actions, with the deprivation of convicted persons of the right to occupy official and materially responsible posts for certain periods.

In addition, the court decided to make submissions for the deprivation of special ranks and state awards (article 52 of the Criminal Code of the Republic of Uzbekistan) convicted for committing grave and especially grave crimes Kadirova R., Mirzaeva M., Mirzaeva A., Fayzieva J., Sunnatova U ., Pulatova R., Khurramova U. and Gaipova U.

It was determined to turn the funds seized and described in the course of the inquiry and preliminary investigation, as well as property, in order to pay off material damage caused by the crimes of which the defendants were found guilty.

Also, the court, in accordance with Article 298 of the Code of Criminal Procedure, issued a private determination addressed to the Prosecutor General of the Republic of Uzbekistan, on the elimination of the causes of crimes and the conditions that contributed to its commission.

Following the pronouncement of the verdict, the presiding judge explained in detail to the participants in the trial the content and essence of the decision, the time frame and the procedure for appealing it.
