Qualification commissions will suspend the notary’s license

Tashkent, Uzbekistan (UzDaily.com) -- By order of the Minister of Justice, the Regulation on Qualification Commissions under the Ministry of Justice of the Republic of Karakalpakstan, Tashkent City and Regional Departments of Justice was approved.

The document was developed in accordance with the Law “On Notaries” and in the framework of the implementation of the Presidential resolution from 13 April 2018 No. PP-3666 “On organizational measures to further improve the activities of the Ministry of Justice of the Republic of Uzbekistan”.

The qualification commission is created by order of the head of the territorial justice department for a period of three years. It includes representatives of the territorial administration of the Notary Chamber of Uzbekistan, notaries, justice authorities in an odd amount from 5 to 9 people. The Commission, within its powers, is independent in making decisions. Intervention in its activities is not allowed.

The deputy head of the territorial department of justice, who oversees the notary public, is usually the chairman of the commission. While he is on leave, on a business trip, or absent from work for other valid reasons, by order of the head of the territorial department of justice, another deputy is temporarily appointed by the chairman.

The basis for consideration by the qualification commission of the issue of suspension of a license or an application to the administrative court to terminate a notary’s license is a representation of the territorial administration of justice or the territorial administration of the notarial chamber.

The Regulation spells out the duties and the work procedure of the chairman and secretary of the commission for organizing activities, as well as the procedure for preparing and holding meetings, lists offenses that are considered a one-time gross offense committed by a notary.

The minutes of the meeting of the qualification commission is signed by each of its members and submitted for approval by the chairman. After approval, the secretary, within one day after the meeting, ensures the distribution of copies of the protocol to the relevant territorial departments of justice, the notarial chamber, and also to the notary public. If the notary disagrees with the decision of the qualification commission, a procedure has been established for appealing against this decision to the Higher Qualification Commission under the Ministry of Justice or to the court.
