Tashkent, Uzbekistan (UzDaily.com) - The Resolution of the Government approved the Administrative Regulation for the provision of public services for licensing private notarial activities.
Accordingly, a license applicant must:
- be at least 25 years old and not older than 65 years;
- have a higher legal education;
- have 3 years of experience in the legal profession (including those who have been trained in the notary's office for at least 1 year);
- pass a qualification exam.
Persons who have worked as a judge for at least 5 years or as a notary public assistant or in the posts of the judicial authorities related to the management and control of notarial activities for at least 3 years are entitled to pass the qualification exam without undergoing an internship.
To obtain a license, applicants personally apply to the Public Service Centers (PSC) or register on the Unified Portal of Interactive Public Services (EPIGU).
The application is filled out at PSC by the center employee, and personally at EPIGU. Relevant documents are attached to the application electronically.
For the provision of public services, a fee of one-half the amount of basic estimated value is charged (111 thousand 500 soums). When applying through EPIGU, 90 percent (100 thousand 350 soums.) of the amount of the fee is charged.
The Higher Qualification Commission under the Ministry of Justice shall consider the information presented in the application within 15 business days.
Based on the results of the review, a conclusion is adopted and approved on the applicant’s participation in the qualification exam or on the refusal to participate.
The qualification exam is held after 5 days, but no later than 15 days from the date of approval of the conclusion on the advisability of the applicant to participate in the qualification exam.
An applicant with more than 55 percent of the highest score that can be obtained is considered to have passed the exam.
An extract from the decision on the applicant who successfully passed the qualification exam will be sent to the appropriate justice authority to obtain a license.
After the applicant has paid the state fee in the amount established by law to obtain a license:
- the licensing authority draws up the license with the QR code affixed and sends it to the TSU or to the applicant through EPIGU;
- PSC on the day of receipt of the license sends it to the applicant’s email address or, upon request, issues the license in paper form.
A license to practice private practice with current state notaries is directly issued by the Ministry of Justice of Karakalpakstan, and territorial departments of justice only on the basis of their applications.
