President abolishes separate planned and control inspections of business entities
Tashkent, Uzbekistan (UzDaily.com) -- President of Uzbekistan Shavkat Mirziyoyev canceled certain planned and control inspections of business entities from 1 September 2018.
President of Uzbekistan Shavkat Mirziyoyev signed a decree “On measures to further improve the system of protection of rights and legitimate interests of business entities”.
In particular, scheduled inspections that are not related to financial and economic activities of companies are canceled. Also, control checks are canceled.
The decree said that starting from 1 September2018, the initiation of inspections of the activities of business entities is carried out on the basis of the results of the "risk analysis" system, which involves the initiation of inspections, based on the degree of risk that the relevant entrepreneurial entity violates the law.
The General Prosecutor’s Office of the Republic of Uzbekistan is the authorized body for coordinating inspections of the activities of business entities.
All inspections of the activities of business entities conducted by regulatory bodies are subject to compulsory registration in the Single Electronic Registrar of Inspections.
Inspections of the activities of business entities conducted without registration in the Single Electronic Registrar of Inspections are illegal, the decree said.
The results of the conducted inspections of the activities of business entities are entered by the regulatory authorities into the Single Electronic Registrar of Inspections within three days after their completion.
The supervisory bodies are instructed to develop and approve the relevant provisions on the procedure for introducing a "risk analysis" system into their operations before 1 September 2018, in consultation with the General Prosecutor’s Office and the Chamber of Commerce and Industry of the Republic of Uzbekistan.
The National Project Management Agency under the President of the Republic of Uzbekistan should assist the supervisory bodies in introducing a risk analysis system into their activities.
The Ministry for Development of Information Technologies and Communications will develop a pilot version of the Single Electronic Registrar of Inspections until 1 September and will launch its full version from 1 January 2019.
The system will allow the authorized body to study the validity of decisions taken to conduct inspections and issue a permit with a unique code for their conduct, supervise compliance by the regulatory authorities with the procedure for conducting inspections established by law.
Supervisory authorities will also be able to introduce to the system the results of the inspections carried out. Entrepreneurs will be able to receive on request information about the audit in the form of short messages (SMS), as well as via the Internet in real time.
