Intellectual Property Agency transferred to the Ministry of Justice

Tashkent, Uzbekistan (UzDaily.com) -- The Agency on Intellectual Property of the Republic of Uzbekistan was transferred to the system of the Ministry of Justice of the Republic of Uzbekistan.

President Uzbekistan Shavkat Mirziyoyev signed a resolution "On measures to improve public administration in the field of intellectual property."

The activities of the Agency in the field of legal protection of intellectual property and the implementation of generally accepted international standards in this area have been recognized as unsatisfactory.

The Agency, including the Training Center for retraining and advanced training of personnel in the field of intellectual property, is transferred to the Justice Ministry with the existing staff and material and technical base in full, while maintaining the current procedure for financing, remuneration and material incentives.

The agency is headed by the Deputy Minister of Justice of the Republic of Uzbekistan - the director appointed and dismissed by the President of the Republic of Uzbekistan.

Deputy Directors of the Agency are appointed and dismissed by the Minister of Justice of the Republic of Uzbekistan in the prescribed manner.

From 1 March 2019, after filing applications for registration of a trademark, service mark and appellation of origin, the Agency within one working day places information on these applications on its official website.

Producers, suppliers, sellers or their representatives after the publication of applications can submit to the Agency written comments about the bad faith of the submitted application for registration.

The exclusive right to a trademark and service mark arises from the date of its registration in the State Register of Trademarks with the obligatory placement of information on registration sign on the official website of the Agency.

A trademark certificate may be terminated prematurely in full or in part on the basis of a court decision taken at the request of the person concerned if the trademark is not used in the territory of the Republic of Uzbekistan continuously for the last three years of its operation, as well as in violation of the collective mark use agreement.

From 1 September 2019, the procedure for filing applications for registration of a trademark will be carried out exclusively in electronic form through public service centers or the Unified portal of interactive public services of the Republic of Uzbekistan.

The Ministry of Justice, the Ministry for Development of Information Technologies and Communications, before 1 July 2019, were entrusted with submitting to the Cabinet of Ministers of the Republic of Uzbekistan draft administrative regulations on the provision of relevant state services.

The head of Uzbekistan approved a "road map" to ensure effective protection of intellectual property in accordance with the annex.

From 1 September 2019, patent attorneys must at least once every five years improve their qualifications in the field of intellectual property with subsequent certification.
