Tashkent, Uzbekistan (UzDaily.com) –– Ensuring openness and transparency, competition and objectivity, soundness, rationality, economy and efficiency of using financial resources in public procurement is a requirement of the time.

On 7 May 2020, the draft order of the Cabinet of Ministers of the Republic of Uzbekistan was submitted to the Ministry of Finance for approval.

This draft resolution envisages a norm according to which, in order to strengthen the material and technical base of the Ministry of Construction of the Republic of Uzbekistan, it is proposed, as an exception, to purchase a Land Cruiser 200 car without competitive bidding, based on direct conclusion of an agreement.

The purpose of the Law of the Republic of Uzbekistan “On public procurement” is to regulate relations in the field of public procurement. 4-12 articles of this law define the basic principles that should be applied at each stage of public procurement.

According to paragraph 27 of the Decree of the President of the Republic of Uzbekistan from 13 August 2019, ministries and departments, as well as local government and executive authorities, are prohibited from preparing and submitting draft regulatory acts to the Cabinet of Ministers providing for the provision of an exclusive conclusion procedure direct contracts in public procurement.

Due to the inconsistency of the norm introduced in the draft order providing for the procurement on the basis of a direct contract of the requirements of the legislation on public procurement, as well as to ensure openness, transparency, competition, as well as the efficient use of financial resources for procurement, the Ministry of Finance sent comments to the project developer with the exception of this norm from the draft order.
