Debtors Granted Right to Suspend Enforcement Proceedings by Depositing Guarantee Funds
Tashkent, Uzbekistan (UzDaily.com) — President of Uzbekistan Shavkat Mirziyoyev has signed a law amending the Law “On the Enforcement of Judicial Acts and Acts of Other Authorities.”
Under the new provisions, a debtor is granted the right to deposit guarantee funds within the framework of enforcement proceedings. This deposit serves as a financial assurance for fulfilling obligations under a property-related judicial act by fully or partially transferring funds to the deposit account of the enforcement authority.
Depositing guarantee funds may serve as grounds for suspending enforcement proceedings, as well as for lifting previously imposed restrictions on the debtor and their property.
The use of guarantee funds is envisaged in cases where a court upholds a complaint or protest against a judicial act that served as the basis for issuing a writ of execution, or when a complaint is filed against the actions or decision of a state enforcement officer.
Refunds of guarantee funds are to be made within three days after the annulment of the judicial act that served as the basis for issuing the writ of execution, or after the actual fulfillment of the corresponding enforcement document.
